Public Offer Agreement

This Public Offer Agreement (hereinafter “Agreement”) is an official offer by Torebek Bekbolatuly (Individual Entrepreneur), hereinafter referred to as the “Service Provider”, to any individual or legal entity, hereinafter referred to as the “User”, to enter into a contract for the provision of services under the terms set forth below.

In accordance with Article 395 of the Civil Code of the Republic of Kazakhstan, this document is a public offer (proposal). Acceptance of this offer is deemed to be the User's registration on the website zhaicv.space and/or payment for any service provided through the platform.

• Platform — the website zhaicv.space and all its services, including AI resume tailoring, ATS score analysis, cover letter generation, and PDF resume generation.
• Service — the set of services provided by the Service Provider to the User through the Platform, as described in Section 3.
• Account — the User's personal account on the Platform, created upon registration.
• Subscription — a paid plan that provides the User with expanded access to Platform features for a specified period.
• Acceptance — full and unconditional acceptance of this Agreement by the User through registration on the Platform or payment for services.

The Service Provider provides the User with access to the following services through the Platform:

• AI-powered resume tailoring based on job descriptions
• ATS (Applicant Tracking System) compatibility scoring
• Resume quality analysis and scoring
• Cover letter generation
• PDF resume generation using professional templates
• Resume storage and management

Services are provided in accordance with the User's selected plan (Free, Starter, Pro, or Power), each with specific usage limits as described on the Platform's pricing page.

This Agreement is considered accepted (the offer is accepted) from the moment:

• The User creates an account on the Platform; or
• The User makes a payment for any paid service or subscription.

By accepting this Agreement, the User confirms that they have read, understood, and agree to be bound by all terms of this Agreement, as well as the Privacy Policy and Terms of Service.

The Platform offers the following service plans:

• Free — limited access at no charge (3 resume tailors/month, 5 ATS scans/day, 3 PDF templates, watermark on PDFs)
• Starter — expanded access for active job seekers (20 tailors/month, 10 ATS scans/day, all templates, 5 cover letters/month)
• Pro — comprehensive access for serious job seekers (100 tailors/month, unlimited ATS scans, unlimited cover letters, priority AI)
• Power — maximum access (300 tailors/month, everything in Pro, priority support, early access to features)

Current pricing is published on the Platform's pricing page. The Service Provider reserves the right to change prices with at least 30 days' notice to existing subscribers. Price changes do not affect active subscription periods.

Payment for paid plans is made through the payment methods available on the Platform. Payment is considered received when the funds are credited to the Service Provider's account.

Subscriptions are billed on a recurring basis (monthly or annually, depending on the selected billing cycle) until cancelled by the User.

All prices are displayed in US Dollars (USD) unless otherwise indicated.

The Service Provider undertakes to:

• Provide the User with access to the Platform and its services in accordance with the selected plan
• Ensure the security and confidentiality of the User's personal data in accordance with the Privacy Policy
• Notify the User of significant changes to the service or this Agreement
• Provide technical support via email

The Service Provider reserves the right to:

• Temporarily suspend the Platform for maintenance or updates
• Modify the functionality and features of the Platform
• Suspend or terminate User accounts that violate this Agreement
• Change pricing with advance notice as specified in Section 5

The User has the right to:

• Use the Platform's services in accordance with the selected plan
• Contact technical support for assistance
• Cancel their subscription at any time
• Request deletion of their account and personal data

The User undertakes to:

• Provide accurate information during registration
• Not share account credentials with third parties
• Not attempt to bypass usage limits or security measures
• Not use the Platform for illegal purposes or to create fraudulent content
• Review AI-generated content before submitting to employers

The User may request a refund within 7 (seven) calendar days from the date of payment if:

• The service was not provided or was provided with significant defects
• The User has not used any paid features during the refund period

Refund requests should be sent to torebekbekbolatovic@gmail.com with the subject line “Refund Request” and must include the User's email address and reason for the refund.

Refunds are processed within 10 business days using the original payment method. Partial refunds may be issued for partially used subscription periods at the Service Provider's discretion.

The Platform is provided “as is”. The Service Provider does not guarantee:

• That AI-generated content will result in interviews or job offers
• Uninterrupted availability of the Platform
• The accuracy or completeness of AI-generated suggestions

The Service Provider's total liability under this Agreement shall not exceed the amount paid by the User for services in the 12 months preceding the claim.

The User acknowledges that they are solely responsible for reviewing and verifying all AI-generated content before use.

The Service Provider processes the User's personal data in accordance with the Privacy Policy and the Law of the Republic of Kazakhstan “On Personal Data and Their Protection” (No. 94-V, dated May 21, 2013).

By accepting this Agreement, the User consents to the collection, processing, and storage of their personal data as described in the Privacy Policy.

The User retains full ownership of their original resume content and any data they upload to the Platform.

AI-generated output (tailored resumes, cover letters, scores) is considered a derivative work of the User's original content. The User has full rights to use, modify, and distribute such output.

The Platform itself, including its design, code, algorithms, and branding, is the intellectual property of the Service Provider.

This Agreement enters into force upon acceptance and remains in effect until:

• The User deletes their account; or
• The Service Provider terminates the User's account due to violation of this Agreement; or
• The Platform ceases operations.

Upon termination, the User's personal data will be deleted within 30 days in accordance with the Privacy Policy.

Neither party shall be liable for failure to fulfill obligations under this Agreement if such failure is caused by force majeure circumstances, including but not limited to: natural disasters, wars, government actions, internet outages, cyberattacks, or third-party service provider failures.

All disputes arising from this Agreement shall be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the courts of the Republic of Kazakhstan in accordance with applicable law.

The Service Provider reserves the right to amend this Agreement at any time. Changes will be published on the Platform and take effect 14 days after publication. Existing subscribers will be notified of material changes via email. Continued use of the Platform after changes take effect constitutes acceptance of the amended Agreement.
